Điều 30. Vi phạm các quy định về bảo vệ môi trường nơi công cộng, khu đô thị, khu dân cư và làng nghề
1. Phạt tiền từ 1.000.000 đồng đến 2.000.000 đồng đối với hoạt động quản lý công viên, khu vui chơi, giải trí, khu du lịch, chợ, nhà ga, bến xe, bến tàu, bến cảng, bến phà và khu vực công cộng khác có một trong các hành vi sau đây:
a) Không niêm yết quy định về giữ gìn vệ sinh môi trường ở nơi công cộng;
b) Không có đủ công trình vệ sinh công cộng, phương tiện, thiết bị thu gom chất thải đáp ứng yêu cầu giữ gìn vệ sinh môi trường theo quy định;
c) Không có đủ lực lượng thu gom chất thải, làm vệ sinh môi trường trong phạm vi quản lý theo quy định.
2. Phạt tiền từ 50.000.000 đồng đến 100.000.000 đồng đối với hoạt động sản xuất, kho tàng sau đây không thực hiện đúng quy định về khoảng cách an toàn về bảo vệ môi trường đối với khu dân cư:
a) Có chất dễ cháy, dễ gây nổ;
b) Có chất phóng xạ hoặc bức xạ mạnh;
c) Có chất độc hại đối với sức khỏe con người và gia súc, gia cầm;
d) Phát tán mùi ảnh hưởng xấu tới sức khỏe con người.
3. Phạt tiền từ 200.000.000 đồng đến 250.000.000 đồng đối với chủ đầu tư xây dựng mới khu đô thị, khu dân cư tập trung, khu chung cư có hành vi bàn giao công trình đưa vào sử dụng mà không thực hiện đúng và đầy đủ một trong các yêu cầu về bảo vệ môi trường sau đây:
a) Không có kết cấu hạ tầng về bảo vệ môi trường phù hợp với quy hoạch đô thị, khu dân cư tập trung đã được cơ quan nhà nước có thẩm quyền phê duyệt;
b) Không có thiết bị, phương tiện thu gom, tập trung chất thải rắn sinh hoạt phù hợp với khối lượng, chủng loại chất thải và đủ khả năng tiếp nhận chất thải đã được phân loại tại nguồn từ các hộ gia đình trong khu dân cư;
c) Không bảo đảm các yêu cầu về cảnh quan đô thị, vệ sinh môi trường;
d) Không có hệ thống tiêu thoát nước mưa, nước thải riêng biệt phù hợp với quy hoạch thoát nước thải, bảo vệ môi trường của khu dân cư;
đ) Không có nơi tập trung rác thải sinh hoạt bảo đảm vệ sinh môi trường;
e) Không có hệ thống xử lý nước thải đạt quy chuẩn kỹ thuật môi trường.
4. Vi phạm các quy định về bảo vệ môi trường trong hoạt động sản xuất, kinh doanh, dịch vụ trong làng nghề bị xử phạt như sau:
a) Phạt cảnh cáo hoặc phạt tiền từ 50.000 đồng đến 200.000 đồng đối với hành vi không thực hiện các quy định về bảo vệ môi trường làng nghề;
b) Cá nhân, tổ chức có hoạt động sản xuất, kinh doanh, dịch vụ trong làng nghề vi phạm hành chính về bảo vệ môi trường bị xử phạt như đối với cá nhân, tổ chức hoạt động bên ngoài các làng nghề quy định tại Nghị định này.
5. Hình thức xử phạt bổ sung:
Đình chỉ hoạt động của cơ sở từ 06 tháng đến 12 tháng đối với các trường hợp vi phạm quy định tại Khoản 2 Điều này.
6. Biện pháp khắc phục hậu quả:
a) Buộc thực hiện đúng quy định về khoảng cách an toàn về bảo vệ môi trường đối với khu dân cư quy định tại Khoản 2 Điều này; trường hợp không thể thực hiện được đúng khoảng cách an toàn về bảo vệ môi trường theo quy định thì phải di dời ra khỏi khu dân cư;
b) Buộc phải xây lắp công trình bảo vệ môi trường theo quy định trong thời hạn do người có thẩm quyền xử phạt ấn định trong quyết định xử phạt vi phạm hành chính đối với các vi phạm quy định tại Điểm b Khoản 1 và Khoản 3 Điều này;
c) Buộc chi trả kinh phí trưng cầu giám định, đo đạc và phân tích mẫu môi trường trong trường hợp có vi phạm về xả chất thải vượt quy chuẩn kỹ thuật môi trường hoặc gây ô nhiễm môi trường theo định mức, đơn giá hiện hành đối với các vi phạm quy định tại Điều này;
d) Buộc thực hiện các biện pháp khắc phục tình trạng ô nhiễm môi trường trong thời hạn do người có thẩm quyền xử phạt ấn định trong quyết định xử phạt vi phạm hành chính đối với các vi phạm quy định tại Điều này gây ra

c) Failing to ensure the requirements of the urban landscape, and environmental sanitation;

e) There is no concentration of waste ensuring environmental hygiene;
e) There is no sewage system reaching environmental technical regulations.
4. Violation of regulations on environmental protection in production, business and services in the village will be fined as follows:
a) A caution or a fine of 50,000 to 200,000 for failing to carry current regulations on environmental protection villages;
b) Individuals and organizations engaged in production, business and services in violation of administrative villages in environmental protection as against the sanctioned individuals , organizations working outside the village specified in this Decree.
5. Forms of additional sanction:
Suspension of operation of the facility from 06 months to 12 months, for violations specified in paragraph 2 of this Article.
6. Remedial measures:
a) Forced compliance with regulations on the safety distance on environmental protection for residential areas defined in paragraph 2 of this Article; case can not be properly implemented safe distance on environmental protection as prescribed, they have to move out of residential areas;
b) Forced to construction and installation of environmental protection within the time limit prescribed by the authorized sanctions set out in the decision of administrative punishment for violations prescribed in Clause 1 and Clause 3 of this Article;
c) Compulsory funds pay for expertise, measurement and classification environmental sample volume in case of violations of waste discharge exceeds environmental technical regulations or polluting the environment according to the norms, the current unit price for violating the provisions of this Article;
d) Forcible take measures to redress the environmental pollution within authorized by the sanction set out in the decision of administrative punishment for violations prescribed in this Article
