6.4 Trường hợp hai bên không thống

6.4 Trường hợp hai bên không thống nhất được với nhau về nguyên nhân và mức độ thiệt hại thì sẽ trưng cầu giám định độc lập, hai hên thống nhất lựa chọn đơn vị giám định để tiến hành giám định. Trường hợp hai bên không thỏa thuận được việc trưng cầu giám định độc lập thì một trong hai bên yêu cầu Tòa án nơi xảy ra tổn thất hoặc nơi cư trú của bên A chỉ định giám định viên độc lập. Kết luận của giám định viên độc lập có giá trị bắt buộc với hai bên. Nếu kết quả giám định của cơ quan giám định độc lập trùng với kết quả giám định của bên B thì bên A phải thanh toán chi phí giám định.
