Article 10: Transfer of rights and obligations
10.1 The purchaser may perform transactions for apartments, such as assignment, mortgage, residential rental, donation and other transactions in accordance with the law back home in after being granted the certificate.
10.2 In no case is handed apartment from the Seller, the Buyer has the right to assign the contract to a third party (hereinafter referred to as the "Assignee") after meet the conditions and comply with the following procedures:
a) The buyer must complete the payments due to the Seller as stipulated in the contract and any overdue interest (if any);
b) Recipients transfer must be eligible to sign and implement this Agreement in accordance with the law at the time of transfer of the contract;
c) The transferee agrees to abide by the terms of the contract and the Fathers Attachment to this Agreement;
d) any amount that the buyer has paid for the Seller up to the date of transfer will not be refunded but will be transferred to the Assignee. Accordingly all the rights, responsibilities and obligations of the Purchaser will transfer to transferees after the date of the Seller up
to the written confirmation transfer Apartment purchase agreement;
e) The Seller will not be responsible responsible for any taxes, charges, fees and other costs related to the transfer agreement between the Purchaser and transferees;
f) Have a written consent authorizing the transfer (unwinding) the bank in case the buyer the right to buy the apartment used as collateral for bank loans (if any);
g) Having written transfer agreement signed between the Buyer and The transferee be notarized;
h) The Seller, the Buyer and The transferee has signed a written agreement on the transfer of the contract and the buyer has handed over to the sale of payment of personal income taxes related to the transfer of contracts or documents certifying the income tax exemption, the original Contract.
10.3 The seller has the right to stop certifying the assignment of the contract (such as apartments are in the process of applying for the certificate, the mortgage bank, blocked / prevented by the decision of the competent state, ...) as defined by law.
10.4 In the case above, home buyers or transferees contract are entitled to interests and fulfill the obligations of the Buyer specified in this Agreement and in the Building Rules.
