Nếu Bên B hoàn thành Hợp đồng công

Nếu Bên B hoàn thành Hợp đồng công trình chậm hơn tiến độ chung đã ký kết theo khoản 3.1thì bên B bị phạt (0,1%) (không phẩy một phần trăm) giá trị Hợp đồng cho mỗi ngày chậm tiến độ. Tổng số tiền phạt không vượt quá 8% (tám phần trăm) giá trị hợp đồng. Trong đợt thanh toán kế tiếp, Bên A sẽ tạm giữ do việc chậm tiến độ và được hoàn trả lại khi Bên B đuổi kịp tiến độ chung nhưng tổng thể mà chậm thì vẫn bị phạt và không được trả lại.
Bên A chậm thanh toán theo điều 5.2 thì Bên A sẽ chịu thêm phần lãi theo lãi suất tiền gửi kỳ hạn 1 tháng của ngân hàng nhà nước tại thời điểm thanh toán và sẽ cộng dồn vào giá trị thanh toán cho Bên B kỳ tiếp theo.
