- Hiệu lực của bảo lãnh thực hiện H

- Hiệu lực của bảo lãnh thực hiện Hợp đồng:
+ Bảo lãnh thực hiện hợp đồng có hiệu lực kể từ ngày Bên Mua mở thư tín dụng (L/C) cho hợp đồng đến sau ngày Chứng nhận bàn giao tạm thời của Tổ máy cuối cùng được phát hành và Bên Mua nhận được Bảo lãnh bảo hành theo quy định.
- Các chi phí mở và duy trì Bảo lãnh thực hiện hợp đồng sẽ do Bên Bán chịu.
- Giá trị của Bảo lãnh thực hiện hợp đồng không đổi trong trường hợp cần gia hạn
hiệu lực của bảo lãnh. Bên Mua có quyền gửi thông báo yêu cầu ngân hàng tạm thời không hoàn trả Bảo lãnh thực hiện hợp đồng khi Bên Bán chưa hoàn thành các nghĩa vụ theo quy định của hợp đồng.
Nếu Bên Mua xét thấy Bên Bán không thể hoàn thành các nghĩa vụ trong thời gian quy định của hợp đồng hoặc theo thời hạn được điều chỉnh theo Điều kiện chung của Hợp đồng (ĐKC)-15 thì Bên Mua sẽ phát hành văn bản yêu cầu Bên Bán gia hạn bảo lãnh thực hiện hợp đồng. Bên Bán phải có trách nhiệm gia hạn bảo lãnh thực hiện hợp đồng và đảm bảo Bên Mua nhận được Bảo lãnh thực hiện hợp đồng trước thời điểm hết hạn của bảo lãnh thực hiện hợp đồng trước đó hai mươi (20) ngày. Nếu Bên Bán không gia hạn hiệu lực của bảo lãnh thực hiện hợp đồng thì Bên Mua có quyền thông báo ngân hàng và tịch thu bảo lãnh thực hiện hợp đồng trước thời điểm hết hạn 48 giờ.
Giá trị của bảo lãnh thực hiện hợp đồng sẽ giữ nguyên trong mọi trường hợp khi kéo dài bảo lãnh thực hiện hợp đồng. Bên Mua có quyền phát hành thư yêu cầu Ngân hàng tạm thời chưa hoàn trả bảo lãnh thực hiện hợp đồng khi Bên Bán chưa hoàn thành nghĩa vụ theo Hợp đồng.

The buyer has the right to submit the required notice of temporary non-refundable bank guarantee contract fulfillment when the seller has not fulfilled the obligations under the provisions of the contract.If Buyer deems the seller can not fulfill their obligations within the time specified by the contract or under the time limit be adjusted according to the General conditions of contract (DKC)-15 then the buyer will issue a written request to the seller to extend the guarantee contract fulfillment. The seller is responsible for the extension of the guarantee contract fulfillment and ensure the buyer receives guarantees implementation of the contract before the expiration of the guarantee contract made before that twenty (20) days. If the seller does not extend the validity of the guarantee contract fulfillment, then the buyer has the right to notify the Bank and confiscated the guarantee made the contract before the expiration of 48 hours.The value of the guarantee contract execution will remain in all cases when extending the guarantee contract fulfillment. The buyer has the right to issue temporary Bank not required to refund the guarantee contract fulfillment when the seller has not fulfilled obligations under the contract.

- The validity of the guarantee contract performance:
+ contract performance guarantee takes effect from the date the Purchaser open letter of credit (L / C) for the contract until after Confirmation temporary handover of Unit finally been released and the Purchaser receives the warranty guarantee prescribed.
- The cost of opening and maintaining contract performance guarantee shall be borne by the Seller bear.
- Value of performance guarantee contracts unchanged in case of necessity to extend
the validity of the guarantee. The Purchaser has the right to send a notice requiring temporary bank refund guarantee contract performance as Seller unfinished obligations under the provisions of the contract.
If the Purchaser deems Seller can not fulfill the obligations within the time prescribed by the contract or time limit be adjusted to the General Conditions of Contract (DKC) -15, the Buyer will issue a written request for an extension Vendor contract performance guarantee. Seller shall have extended the contract performance guarantee and assure the Purchaser receives the contract performance guarantee prior to the expiration of the guarantee contract performance before twenty (20) days. If the Seller does not extend the validity of the contract performance guarantee, the Purchaser has the right to inform the bank and confiscate the performance guarantee contract before the expiration of 48 hours.
The value of the contract performance guarantee will remain in all cases when prolonged guarantee of contract performance. The Purchaser has the right to issue letters of request temporary bank refund guarantees not to perform the contract if the Seller has not fulfilled their obligations under the Contract.
