Mục 5. XỬ LÝ VI PHẠM NGHĨA VỤ CỦA NGƯỜI ĐƯỢC BẢO LÃNH
Điều 33. Xử lý vi phạm nghĩa vụ trả nợ đối với khoản vay, khoản phát hành trái phiếu được Chính phủ bảo lãnh
1. Người được bảo lãnh không có khả năng thực hiện toàn bộ hoặc một phần nghĩa vụ nợ đến hạn có trách nhiệm:
a) Báo cáo Công ty mẹ, cổ đông chi phối (nếu có) 180 ngày trước kỳ trả nợ để trả nợ thay;
b) Báo cáo bằng văn bản cho Bộ Tài chính và Bộ, cơ quan ngang Bộ chủ quản (nếu là doanh nghiệp, tổ chức tài chính tín dụng nhà nước).
2. Trường hợp Công ty mẹ cổ đông chi phối không có khả năng trả nợ thay (không có lãi và không cân đối đủ nguồn), người được bảo lãnh báo cáo bằng văn bản cho Bộ Tài chính 90 ngày trước ngày đến hạn, nêu rõ:
a) Lý do người được bảo lãnh và công ty mẹ, cổ đông chi phối (nếu có) không có khả năng thanh toán nợ đến hạn cho người cho vay theo cam kết;
b) Báo cáo tài chính của năm liền kề trước đó và báo cáo 6 tháng (nếu có) của người được bảo lãnh và công ty mẹ, cổ đông chi phối (nếu có);

Article 33. Handling of violations of obligations on repayment of loans, bond issuance amounts are government-guaranteed
1. The guaranteed inability to perform the whole or part of the debt maturity obligations shall:
a) report on the parent company, controlling shareholders (if any) 180 days before repayment period to repay debts ;
b) report in writing to the Ministry of Finance and ministries, ministerial-level agencies in charge (if the business, financial and credit institutions of state).
2. Where the parent company controlling shareholder has no ability to repay debts (without interest and unbalanced enough resources), the guaranteed written report to the Ministry of Finance 90 days before the due date, stating :
a) The reason for the guaranteed and the parent company, controlling shareholders (if any) does not have the ability to pay its debts to the lending term commitments;
b) financial statements of the year preceding and 6-month report (if any) of the guaranteed and the parent company, controlling shareholders (if any);
