từ cuối thế kỉ XIX đường biên giới Việt Nam được hoạch định trong công ước hoạch định biên giới ngày 26/6/1887/ . Công ước biên giới ngày 20/6/1895 kí kết giữa Pháp và nhà Thanh ( Trung Quốc). Trong những năm 70 của TK XX, với mục tiêu xác lập một đường biên giới rõ ràng giữa hai nước, Việt Nam và Trung Quốc đã tiến hành ba lần đàm phán, giải quyết vẫn đề biên giới ,sau đó đàm phán bị gián đoạn do những biến cố lịch sử. Cuộc đàm phán được đàm nối lại ngay sau khi nước ta và Trung Quốc bình thường quan hệ năm 1991. Chính vì vậy việc ngày càng phải hoàn thiện khung pháp lí biên giới giữa hai nước là rất quan trọng
