Article 14. Procedure decided to put base Ship demolition operation
• 1. Ship Enterprise demolition submitted directly to the Vietnam Maritime Administration, or sent via the postal system or by using the appropriate form Other 02 (two) dossier proposing demolition base Ship operation.
• 2. Dossiers put base Ship demolition operation consists of the following documents:
• a) Written basis for inclusion Ship demolition operations on Form 1 prescribed in Annex II attached to this Decree (01);
• b) Certificate of registered businesses (01 originals or copies certified);
• c) The decision to approve the environmental impact assessment of base Ship demolition (01 original or certified copy);
• d) certificates of protection environmental service operation phase (01 original or certified copy);
• e) The registration of waste generators of hazardous waste (01 original or certified copy);
• e) License discharge into water (01 original or certified copy);
• g) The text of the plan acceptance prevention and explosives (01 original or certified copy);
• h) Plan oil spill response was competent authorities for approval (01 original or certified copy);
• i) general drawing of the layout location of facility equipment demolition Ship (01 original or certified copy);
• k) The declaration lists direct labor involved in demolition Ship (01 original or certified copy);
• l) Navigation equipment Safety Protection (01 original or certified copy);
• m) Certificate of environmental management systems (01 original or certified copy). Article 14 Procedure for decisions taken base Ship demolition operations ....................................... (continued) • 3. The Vietnam Maritime Bureau received documents, tests and treated as follows: • a) In case of direct filing, if the valid dossiers, the grant receipts records and appointments for returning results within the period prescribed; if no valid records, the guidelines now complete records; • b) Where the dossiers sent by the postal system or by other suitable form, if no valid file, within 02 (two ) working days from the date of receipt, Vietnam Maritime Administration has guidelines now complete the dossier as prescribed; • c) Within 05 (five) working days from the date of receipt valid file, Vietnam Maritime Administration evaluation and report to the Ministry of Transport in writing of the results of appraisal records; • d) At least 03 (three) working days from the date of receipt of the written evaluation and recommendation of the Vietnam Maritime Administration, Department of Transportation issued a decision putting base Ship demolition operations on Form 2 in Annex II attached to this Decree; the absence of consent must be written replies, clearly stating the reasons. Article 15. The decision to stop operating base Ship demolition • 1. Ministry of Transport decided to stop the operation of ship demolition facility sea in the following cases: • a) At the request of a seagoing ship demolition business base by inefficient activities or other legitimate reasons; • b) Basis of violating the regulations on safety maritime, maritime security, safety, prevention of environmental pollution at the request of state agencies having jurisdiction. • 2. The decision to stop the operation of base Ship demolition as follows: • a) Enterprise Ship demolition submitted directly to Vietnam Maritime Administration or by postal system written request to stop operation of the facility dismantled ships. After three (03) working days from the receipt of a written request to stop operation of the facility dismantled ships, Vietnam Maritime Bureau reports the Ministry of Transport decided. • b) At least 05 ( five) working days from the date of receiving the documents of Vietnam Maritime Administration, Ministry of Transport decided to stop operation of the base Ship demolition and inform businesses demolition ships and agencies concerned. • 3. base Ship demolition may have to stop operating under the relevant provisions of law. • Article 16. Decision idled base Ship demolition • 1. Where for reasons of ensuring maritime safety, maritime security, environmental protection or demolition Ship businesses fail to comply with the demolition plan approved seagoing vessels and other emergency reasons, Director of Vietnam National Maritime Bureau decided to temporarily stop operating base Ship demolition at the request of regional port authorities. • 2. Article 17 Planning Ship demolition • 1. Ship demolition plan includes the following main items: • a ) About the ship was dismantled ship's name, nationality ship; name and address of the ship; technical characteristics of the vessel and the general layout drawings of the vessel; • b) Information on base Ship demolition: Name and address of businesses demolition ships and establishments dismantled ships, drawing Ship demolition position in overall ground facility demolition, equipment demolition service, technology demolition, demolition personnel; • c) Ship dismantlement plan together with progress Ship demolition under specific items; • d) safety measures for workers, sanitation and prevention, fire; • e) environmental protection plan in operation dismantled ships have bodies of state management of environmental certification according to the regulations. • 3. Plans for environmental protection activities Ship demolition plan must include environmental incident response, planning collectors, storing, transporting and processing waste generated from demolition activities for each ships. Article 18 Procedure for approval Ship demolition plan • 1. Ship Enterprise demolition submitted directly to the Bureau Maritime Vietnam or sent through the postal system or by other suitable forms 01 (a) dossier requesting approval for the demolition plan for each ship. Dossiers approved demolition plan for each marine vessels include: • a) A written request for approval of plans to demolish Ship Form 3 prescribed in Annex II to this Decree (01 copy ); • b) demolition Ship Plan (01 originals). Article 18 Procedure for the demolition plan approved seagoing vessels • ...... .. (continued) • 2. The Vietnam Maritime Administration Reception sisters, checked and processed as follows: • a) If the receipt directly, if valid, their file receipts records and appointments for returning results within the period prescribed; if no valid records, the guidelines now complete the dossier as prescribed; • b) Where the dossiers sent by the postal system or by other suitable form, if the records are not valid, within 02 (two) working days from the date of receipt, Vietnam Maritime Administration has guidelines now complete the dossier as prescribed; • c) Within 02 (two) working days after the receipt of a valid application, the Vietnam Maritime Bureau shall collect opinions from related agencies on plans to dismantle ships. Within 05 (five) working days from the date of receipt of the written consultation of Vietnam Maritime Administration, the agency concerned shall give its opinion in writing; • d) Within 03 (three) working days from the date of receipt of the opinion of the relevant agencies, the Vietnam Maritime Bureau shall decide whether to approve the demolition plan Ship on Form 4 prescribed in Annex II issued together with this Decree and sent directly to the enterprise demolition ship or sent through the postal system; the absence of approval, Vietnam Maritime Administration must give written replies, clearly stating the reasons. Article 19 Implementation plan Ship demolition demolition • 1. Ship Enterprise to perform demolition Ship as planned demolition ships have been approved and report to Vietnam Maritime Bureau performance results. • 2. The port authority shall, in collaboration with relevant agencies in organizing the inspection, monitoring oversee the implementation of the demolition plan for each ships. • 3. Each year, the Ministry of Transportation report to the Prime Minister on the demolition Ship in Vietnam. Article 20 Enforcement • This Decree shall take effect as of 15 January 2015. 01 Article 21.
