5. 1 Các từ cổ và cụm giới từ

Có khá nhiều từ cổ như “herein” (ở đây), “hereof” (về điều này), “hereto” (theo điều này), “herewith” (kèm theo đây), “thereafter” (sau đó), “thereby” (bằng cách đó),v,v. Những từ này phần lớn là gồm một trạng từ “here”, “there”, đôi khi cũng dùng “where” cọng với một giới từ tạo thành, thường làm trạng ngữ trong câu. Vìrất ít được dùng trong tiếng Anh hiện đại nhưng lại rất phổ biến trong tiếng Anh pháp lý và HĐTM nên cũng gây khó khăn cho người dịch. Các ví dụ ở mục 4.1. các từ gây khó khăn cho người dịch là “hereinafter”, cách viết gọn của cụm từ “hereinafter referred to as” tương đương với tiếng Việt là “gọi tắt là/sau đây gọi là”. Từ “fortnight”, dù lạ về hình thức, nhưng trong HĐTM lại chỉ có nghĩa “at once”/ “immediately”.
