V/v thỏa thuận địa điểm cho Công ty TNHH Bảo Giang lập thủ tục đầu tư khu biệt thự nhà vườn tại xã Phước An, huyện Nhơn Trạch.

Kính gửi:
- Gíam đốc các Sở: Kế hoạch và đầu tư, Xây dựng, Tài nguyên và Môi trường, tài chính, giao thông vận tải;
- Chủ tịch UBND huyện Nhơn Trạch;
- Chủ tịch UBND xã Phước An;
- Gíam đốc Công ty TNHH Bảo Giang.
Sau khi xem xét đề nghị của công ty TNHH Bảo Giang tại văn bản số 35/CV ngày 18/01/2011, về việc đề nghị thỏa thuận địa điểm đầu tư khu biệt thự nhà vườn tại xã Phước An, huyện Nhơn Trạch; ý kiến của UBND huyện Nhơn Trạch tại văn bản số 1163/UBND-KT ngày 24/6/2009. Tờ trình số 155/TTr-UBND ngày 14/7/2009 và Văn bản số 26/UBND-KT ngày 06/01/2010; ý kiến của Sở Kế Hoạch và Đầu tư tại văn bản số 528/SKHĐT-HTĐT ngày 08/4/2011, chủ tịch UBND tỉnh Đồng Nai có ý kiến như sau:
1. Chấp thuận chủ trương và thỏa thuận địa điểm cho công ty TNHH Bảo Giang lập thủ tục đầu tư dự án với nội dung dưới đây:
a) Mục tiêu: đầu tư khu biệt thự nhà vườn theo quy hoạch.
b) Vị trí địa điểm: diện tích khoảng 70 Ha tại xã Phước An, huyện Nhơn Trạch, tỉnh Đồng Nai (Vị trí khu đất được xác định theo sơ đồ giới thiệu địa điểm tỷ lệ 1/15.000 do UBND huyện Nhơn Trạch xác lập ngày 14/7/2009)
c) Gía thuê đất: trong trường hợp thuê đất sẽ được tính chính thức tại thời điểm chủ đầu tư ký hợp đồng thuê đất với nhà nước.
d) Thời hạn hiệu lực của văn bản này là 24 tháng kể từ ngày ký. Hết thời hạn trên, nếu nhà đầu tư chưa hoàn thành thủ tục đầu tư mà không làm thủ tục gia hạn, nếu nhà đầu tư mà không làm thủ tục gia hạn, văn bản thỏa thuận địa điểm không còn hiệu lực pháp lý.

2. Công ty TNHH Bảo Giang có trách nhiệm:
a) Lập thủ tục đầu tư, thủ tục đăng ký doanh nghiệp, đăng ký đầu tư, quyết định cho phép đầu tư theo quy định của Luật Đầu Tư, luật Doanh nghiệp, luật xây dựng, luật nhà ở, luật kinh doanh Bất động sản và các quy định khác có liên quan.
b) Liên hệ UBND huyện Nhơn Trạch, Sở Tài Nguyên và Môi trường để làm thủ tục đất đai, thủ tục Bảo vệ Môi trường theo quy định.
c) Lập quy hoạch và thủ tục xây dựng trình cơ quan có thẩm quyền thẩm định và phê duyệt theo quy định hiện hành. Lưu ý, khi triển khai các bước lập quy hoạch cần đảm bảo giữ được điều kiện địa hình, cảnh quan thiên nhiên, đảm bảo tỷ lệ diện tích cây xanh mặt nước, MĐXD tuân thủ quy chuẩn quy hoạch các tiêu chuẩn xây dựng hiện hành.
Sau khi quy hoạch được duyệt, trường hợp dự án có từ 2.500 căn nhà trở lên thì phải lập hồ sơ báo cáo thẩm duyệt để lập thủ tục trình xin chấp thuận chủ trương của Thủ tướng chính phủ theo quy định tại Nghị định số 7/12010/NĐ-CP ngày 23/6/2010 của chính phủ quy định chi tiết và hướng dẫn thi hành luật nhà ở.
d) Doanh nghiệp có trách nhiệm dành quĩ đất đủ để bố trí tái định cư cho các hộ dân trên khu đất theo quy định và 20% diện tích đất ở của dự án đã đầu tư xây dựng hệ thống hạ tầng kỹ thuật phát triiển nhà ở xã hội theo quy định tại điều 32 Nghị định số 71/2010/NĐ-CP ngày 23/6/2010 của chính phủ quy định chi tiết và hướng dẫn thi hành luật nhà ở.
e) Chỉ được phép sử dụng đất xây dựng công trình và triển khai dự án khi đã hoàn thành các thủ tục đầu tư, đất đai, xây dựng và các thủ tục khác có liên quan theo quy định.
f) Thực hiện các nghĩa vụ tài chính về đầu tư khu dân cư theo quy định.
g) Định kỳ hàng quý , báo cáo bằng văn bản việc triển khai thực hiện các công việc sau khi đã được thỏa thuận địa điểm cho đến khi có quyết định giao đất hoặc cho thuê đất. Báo cáo gửi đến sở kế hoạch và đầu tư và UBND huyện Nhơn Trạch.
3. Chủ tịch UBND huyện Nhơn Trạch, chủ tịch UBND xã Phước An có trách nhiệm thông báo cho các tổ chức, cá nhân liên quan đang sử dụng đất trong khu vực về chủ trương của UBND tỉnh tại Mục 1 nên nêu trên. Việc bồi thường, giải tỏa thực hiện theo các quy định hiện hành./.
