bên B thi công chậm tiến độ quá 10 ngày so với tổng tiến độ mà không do lỗi của bên A hoặc không do lỗi của các nhà thầu khác của bên A hoặc các điều kiện bất khả kháng quy định tại điều 10, bên B sẽ bị phạt tiền 150000000 đồng (một trăm năm mươi triệu đồng), từ ngày chậm tiến độ thứ 11 trở đi bên B chịu phạt 1% giá trị phần bị chậm cho 1 ngày chậm và chịu trách nhiệm thanh toán chi phí trả cho đơn vị thành viên giám sát thi công trong những ngày chậm tiến độ
