Người lao động có thời gian không tham gia bảo hiểm thất nghiệp do nghỉ ốm hoặc nghỉ hưởng chế độ thai sản từ đủ 01 tháng trở lên vẫn được tính là thời gian làm việc thực tế để hưởng trợ cấp thôi việc. Do đó, doanh nghiệp có trách nhiệm chi trả trợ cấp thôi việc cho người lao động đối với thời gian nêu trên.
