TRÍCH YẾU LUẬN VĂN
Luận văn đánh giá công tác quản lý biến dộng đất đai tại quận Long Biên – thành phố Hà Nội giai đoạn từ năm 2011 đến năm 2015 với mục đích nhằm đánh giá thực trạng công tác quản lý các biến động đất đai diễn ra tại quận Long Biên, thành phố Hà Nội và đề xuất một số biện pháp góp phần để công tác quản lý biến động đất đai ngày một có hiệu quả.
Thông qua các phương pháp thu thập số liệu từ các phòng, ban thuộc UBND quận Long Biên, Văn phòng đăng ký đất đai Hà Nội – Chi nhánh quận Long Biên, và phương pháp điều tra, phỏng vấn trực tiếp các hộ dân có thực hiện đăng ký biến động đất đai, các cán bộ địa chính các phường trên địa bàn quận Long Biên; từ đó đánh giá chi tiết việc thực hiện công tác đăng ký biến động và chỉnh lý biến động trên địa bàn, khái quát những ảnh hưởng của công tác quản lý biến động đến việc đăng ký của người dân cũng như công tác chỉnh lý biến động của cơ quan chức năng.
Qua quá trình điều tra, nghiên cứu đã thu về được một số kết quả sau:
- Điều kiện tự nhiên, kinh tế, xã hội của quận Long Biên.
- Tình hình đăng ký biến động đất đai tại cơ quan Nhà nước ở quận Long Biên giai đoạn 2011 – 2015: trên địa bàn quận có tổng cộng 46532 trường hợp đến cơ quan nhà nước để đăng ký biến động, các loại biến động gồm có chuyển nhượng quyền sử dụng đất, tặng cho quyền sử dụng đất, thừa kế quyền sử dụng đất, thế chấp, xóa thế chấp, chuyển mục đích quyền sử dụng đất và đính chính thông tin trên giấy chứng nhận quyền sử dụng đất như: họ tên, địa chỉ, số tờ, số thửa, diện tích, kích thước, nhà ở...
- Kết quả chỉnh lý biến động tại cơ quan nhà nước: Kết quả chỉnh lý biến động của cơ quan nhà nước được đánh giá trên mức độ chỉnh lý biến động của 4 loại hồ sơ địa chính gồm: sổ địa chính, bản đồ địa chính, sổ mục kê, sổ đăng ký biến động.
- Để điều tra thực trạng biến động trên địa bàn quận, tôi đã tiến hành điều tra trực tiếp thông qua phiếu điều tra. Với tổng số phiếu là 200 phiếu trong đó có 172 phiếu điều tra hộ gia đình cá nhân và 28 phiếu điều tra cán bộ địa chính các phường. Qua điều tra thấy được hiểu biết của người dân về đăng ký biến động đất đai đã ngày càng nhiều.
- Từ những kết quả thu được ở trên, tôi đề xuất 4 nhóm giải pháp nhằm nâng cao hiệu quả trong công tác chỉnh lý biến động bao gồm: giải pháp về đội ngũ cán bộ, giải pháp về công nghệ thông tin, giải pháp về chính sách, pháp luật, thủ tục hành chính và giải pháp tuyên truyền vận động.
