THE MINISTRY OF FINANCE--------THE SOCIALIST REPUBLIC OF VIETNAMIndependence-freedom-happiness ---------------Total: 149/2013/TT-BTC Hanoi, on October 29, 2013 CIRCULARSPECIFY COLLECTIBLE, SUBMISSION, MANAGEMENT AND USE OF FEES MANAGING FOOD SAFETY AND HYGIENEFood safety pursuant to the law No. 55/2010/QH12 on June 17, 2010;Pursuant to the Ordinance on fees and charges number 38/2001/PL-UBTVQH10 on 28 August 2001;Pursuant to Decree No. 57/2002/ND-CP dated 3 June 2002 from the Government detailing the implementation of the Ordinance on fees and charges and Decree No. 24/2006/ND-CP dated 6 March 2006 the Government amended and supplemented a number of articles of Decree No. 57/2002/ND-CP dated 3 June 2002;Pursuant to Decree No. 38/2012/ND-CP dated 25 April 2012 of the Government detailing the implementation of some articles of the law on food safety;Pursuant to Decree No. 118/2008/ND-CP dated 27 November 2008 of the Government functions, tasks, powers and organizational structure of the Ministry of finance;At the suggestion of Director General, Tax policy;The Minister of Finance issued a circular regulating the collection, submission, management and use of fees to manage food safety and hygiene, as follows:Article 1. Payers of fees Personal organizer, Vietnam and overseas production, sales, imports are the competent State bodies the certification, validation, checking the hygiene conditions of food safety and testing food safety must submit fees managing food safety under the provisions of this circular.Article 2. The currency 1. The collection of fees to manage food safety and hygiene are specified in the salary Schedule attached to this circular. 2. management fees and food safety currency in Vietnam (VND). Article 3. Organize currency lodging and usage management,1. management fees and food safety as revenues in the State budget.2. The agency fee is 90% (ninety percent) of the amount of charge actually collected to cover the costs of the fee according to the following: a) pay-pay (wages), allowances; the toxic training, made outside of the State administrative regulations; genus workwear and uniforms for employees according to the prescribed regimes; genus fostering professional expertise; the donations under salaries, remuneration for labor (including labor, outsourcing) service costs (excluding salary costs for staff, public servants were paid from the State budget) according to the prescribed regimes; b) direct charges for costs such as office supplies, telephone, electricity, water, diem, the service fee; in (buy) declarations, permits, other types of prints according to current norms, standards;c) genus of frequent repairs, overhaul of property, machinery and equipment for a fee;DD) Genus stores of supplies, materials, equipment, work tool, and other expenses related to the work of a charge according to be the competent bodies for approval; e) Information to profile the appraisal, the Board's activities for the evaluation, approval by decision of the authority. f) spent on advocacy work of quality management and food safety. The amount of the charge was left 90% (ninety percent) to cover the cost of the charge after settlement the right regulatory regime, if not yet spent a year are allowed to move on to the next year to continue to spend according to the prescribed regimes.The total amount of charge actually collected, after subtracting the amount to be taken as the rate prescribed in clause 2 of this, the remaining 10% (ten percent) of the Agency charge a fee to be paid into the State budget according to the index of the current state budget.3. collection agency fees 100% (one hundred percent) of the total amount of fees collected to the State budget according to the index of the current state budget. 4. where the fees earned from services not by State investment or investment by the State but were transferred to organizations and individuals to follow the principle of financial autonomy, accounting, revenue is not part of the State budget. The amount of fees collected as revenue of the organization or individual for a fee; organizations and individuals charge are obliged to pay tax according to the current rules of the State on the results of a charge.Article 4: implementation:1. This circular is effective since December 16th, 2013. Annuls decision No 80/2005/QD-BTC dated 17 November 2005 of the Minister of finance regarding the salary rules, submission, management and use of fees for quality management and food safety and the decision No 57/2006/QD-BTC dated 19 October 2006 on the amendment of the chargesmanagement fees, the quality of food hygiene and safety in decision No. 80/2005/QD-BTC dated 17 November 2005 of the Minister of finance.2. Other content related to the collection, filing, administration, use, publicly charging mode, no guidance in this circular are performed according to the guidance in circular No. 63/2002/TT-BTC dated July 24, 2002 and circular No. 45/2006/TT-BTC dated 25 May 2006 amendingSupplement circular No. 63/2002/TT-BTC dated 24 July 2002 of the Ministry of Finance shall guide the implementation of the legal provisions regarding fees and charges; Circular No. 28/2011/TT-BTC dated 28 December 2010 of the Ministry of Finance shall guide the implementation of some articles of the law on tax administration, guidelines for implementing Decree No. 85/2007/ND-CP dated May 25, 2007 and the Decree No. 106/2010/ND-CP dated 28 October 2010 of the Government regulations detailing the implementation of some articles of the law on tax administration; Circular No. 153/2012/TT-BTC dated September 17, 2012 of the Ministry of Finance shall guide the release, use currency fees in the State budget; Circular No. 64/2013/TT-BTC dated 15 may 2013 of guiding the implementation of Decree No. 51/2010/ND-CP dated 14 May 2010 of the Government regulation on sale of goods, provision of services and the text amended and supplemented.3. organizations and individuals subject to filing fees and related agencies responsible for implementation of this circular. In the course of implementation, if there are obstacles, suggest the Organization, personal reflections in time for the Finance Ministry to consider the instructions./.
