Căn cứ Nghị định số 199/2013/NĐ-CP ngày 26 tháng 11 năm 2013 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Nông nghiệp và Phát triển nông thôn;
Căn cứ Nghị định số 08/2010/NĐ-CP ngày 05 tháng 02 năm 2010 của Chính phủ về quản lý thức ăn chăn nuôi;
Theo đề nghị của Tổng cục trưởng Tổng cục Thủy sản, Cục trưởng Cục Chăn nuôi,
Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Thông tư sửa đổi, bổ sung một số điều của Thông tư số 66/2011/TT-BNNPTNT ngày 10 tháng 10 năm 2011 quy định chi tiết một số điều Nghị định số 08/2010/NĐ-CP ngày 05 tháng 02 năm 2010 của Chính phủ về quản lý thức ăn chăn nuôi.
Điều 1. Sửa đổi, bổ sung một số điều của Thông tư số 66/2011/TT-BNNPTNT ngày 10 tháng 10 năm 2011 quy định chi tiết một số điều Nghị định số 08/2010/NĐ-CP ngày 05 tháng 02 năm 2010 của Chính phủ về quản lý thức ăn chăn nuôi (sau đây gọi là Thông tư 66/2011/TT-BNNPTNT) như sau:
1. Bổ sung Điều 2a:
“Điều 2a. Giải thích từ ngữ
Trong Thông tư này, các từ ngữ dưới đây được hiểu như sau:
1. Lô sản xuất: là sản phẩm thức ăn chăn nuôi có nội dung ghi trên nhãn hoặc tài liệu đính kèm giống nhau, bao gồm: tên sản phẩm, nhãn hiệu, thành phần chất lượng, tên cơ sở sản xuất, địa chỉ sản xuất, ngày sản xuất và hạn sử dụng, ký hiệu lô sản xuất (nếu có).
2. Lô hàng: là hàng hóa thức ăn chăn nuôi cùng một loại của một hoặc nhiều lô sản xuất do cùng một cơ sở sản xuất, cùng một tổ chức nhập khẩu, được nhập khẩu cùng một chuyến hàng và có cùng một bộ hồ sơ nhập khẩu.
3. Chất chính trong thức ăn chăn nuôi: là chất quyết định công dụng và bản chất của sản phẩm, cụ thể:
a) Chất chính trong thức ăn hỗn hợp hoàn chỉnh và thức ăn đậm đặc cho gia súc, gia cầm và thủy sản là protein thô và lysine tổng số;
b) Chất chính trong các loại nguyên liệu và thức ăn chăn nuôi khác là các chỉ tiêu quyết định bản chất, công dụng của sản phẩm do nhà sản xuất công bố và được ghi trên nhãn hàng hóa hoặc tài liệu kỹ thuật kèm theo.”
2. Điều 5 được sửa đổi, bổ sung như sau:
“Điều 5. Công nhận thức ăn chăn nuôi được phép lưu hành tại Việt Nam
1. Thức ăn chăn nuôi được phép lưu hành tại Việt Nam là thức ăn chăn nuôi được Tổng cục Thủy sản hoặc Cục Chăn nuôi công nhận đủ điều kiện lưu hành tại Việt Nam sau khi đã được Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn chấp thuận. Tổng cục Thủy sản, Cục Chăn nuôi có trách nhiệm định kỳ hàng tháng tổng hợp, công bố Danh mục thức ăn chăn nuôi được phép lưu hành tại Việt Nam và đăng tải trên website của Tổng cục Thủy sản, Cục Chăn nuôi và Bộ Nông nghiệp và Phát triển nông thôn để các tổ chức, cá nhân có liên quan truy cập, thực hiện.
2. Thức ăn chăn nuôi được phép lưu hành tại Việt Nam phải đáp ứng các yêu cầu sau đây:
a) Thức ăn chăn nuôi chưa có quy chuẩn kỹ thuật quốc gia: phải công bố tiêu chuẩn áp dụng và có chất lượng phù hợp với tiêu chuẩn công bố áp dụng.
b) Thức ăn chăn nuôi đã có quy chuẩn kỹ thuật quốc gia: ngoài đáp ứng các quy định nêu tại điểm a Khoản 2 Điều này, phải hoàn thiện công bố hợp quy theo quy định.
c) Phải có kết quả khảo nghiệm trên vật nuôi:
Đối với thức ăn hỗn hợp hoàn chỉnh: kết quả khảo nghiệm do Hội đồng cấp cơ sở đánh giá (tổ chức, cá nhân tự tiến hành việc khảo nghiệm và đánh giá kết quả khảo nghiệm theo quy trình khảo nghiệm do Bộ Nông nghiệp và Phát triển nông thôn ban hành);
Đối với thức ăn chăn nuôi mới: kết quả khảo nghiệm do Hội đồng khoa học chuyên ngành được Tổng cục Thủy sản hoặc Cục Chăn nuôi thành lập đánh giá.
3. Hồ sơ đăng ký thức ăn chăn nuôi được phép lưu hành tại Việt Nam bao gồm:
a) Đối với thức ăn chăn nuôi sản xuất trong nước
- Đơn đăng ký thức ăn chăn nuôi được phép lưu hành tại Việt Nam (theo mẫu tại Phụ lục 3 ban hành kèm theo Thông tư này);
- Giấy chứng nhận đăng ký kinh doanh hoặc Giấy chứng nhận đầu tư (bản sao chứng thực, chỉ nộp lần đầu);
- Bản tiêu chuẩn công bố áp dụng (bản chính hoặc bản sao chụp có xác nhận của nhà sản xuất);
- Phiếu kết quả thử nghiệm (bản chính hoặc bản sao chứng thực) các chỉ tiêu chất lượng và vệ sinh an toàn của sản phẩm trong tiêu chuẩn công bố áp dụng hoặc trong quy chuẩn kỹ thuật quốc gia tương ứng được cấp bởi các phòng thử nghiệm do Bộ Nông nghiệp và Phát triển nông thôn chỉ định hoặc thừa nhận (đối với các chỉ tiêu công bố chưa có phương pháp thử được chỉ định). Kết quả khảo nghiệm đối với thức ăn chăn nuôi hỗn hợp hoàn chỉnh. Bản tiếp nhận công bố hợp chuẩn hoặc tiếp nhận công bố hợp quy theo quy định của pháp luật hoặc quyết định công nhận thức ăn chăn nuôi mới;
- Mẫu nhãn của sản phẩm (có đóng dấu xác nhận của nhà sản xuất).
b) Đối với thức ăn chăn nuôi nhập khẩu được quy định cụ thể tại Điều 6 Thông tư 66/2011/TT-BNNPTNT.
4. Hồ sơ đăng ký lại thức ăn chăn nuôi được phép lưu hành tại Việt Nam bao gồm:
a) Đơn đăng ký lại thức ăn chăn nuôi được phép lưu hành tại Việt Nam (theo mẫu tại Phụ lục 4 ban hành kèm theo Thông tư này);
b) Bản tiêu chuẩn công bố áp dụng (bản chính hoặc bản sao chụp có xác nhận của nhà sản xuất), bản tiếp nhận công bố hợp chuẩn hoặc tiếp nhận công bố hợp quy theo quy định của pháp luật hoặc quyết định công nhận thức ăn chăn nuôi mới;
c) Mẫu nhãn của sản phẩm (có đóng dấu xác nhận của nhà sản xuất).
5. Trình tự giải quyết hồ sơ đăng ký thức ăn chăn nuôi được phép lưu hành tại Việt Nam (bao gồm cả đăng ký lại):
a) Tổ chức, cá nhân đăng ký thức ăn chăn nuôi được phép lưu hành tại Việt Nam, lập 01 bộ hồ sơ gửi trực tiếp hoặc qua đường bưu điện về Tổng cục Thủy sản (đối với thức ăn thủy sản) hoặc Cục Chăn nuôi (đối với thức ăn gia súc, gia cầm).
b) Trong thời hạn 03 ngày làm việc kể từ ngày nhận được hồ sơ đăng ký, Tổng cục Thủy sản hoặc Cục Chăn nuôi có trách nhiệm kiểm tra thành phần hồ sơ và thông báo bằng văn bản cho tổ chức, cá nhân đăng ký những thành phần hồ sơ chưa đạt yêu cầu để bổ sung, hoàn thiện. Trường hợp hồ sơ trên 10 sản phẩm thì thời hạn kiểm tra thành phần hồ sơ không quá 05 ngày làm việc.
c) Nếu hồ sơ hợp lệ và sản phẩm đạt yêu cầu chất lượng, trong thời hạn không quá 12 ngày làm việc, Tổng cục Thủy sản hoặc Cục Chăn nuôi ban hành quyết định công nhận thức ăn chăn nuôi được phép lưu hành tại Việt Nam (theo mẫu tại Phụ lục 4A kèm theo Thông tư này) sau khi đã được Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn chấp thuận. Đối với hồ sơ trên 10 sản phẩm thì thời gian giải quyết cho 01 sản phẩm vượt quá được cộng thêm 01 ngày làm việc. Trường hợp không ban hành quyết định công nhận, Tổng cục Thủy sản hoặc Cục Chăn nuôi phải trả lời bằng văn bản và nêu rõ lý do.
6. Thay đổi thông tin của thức ăn chăn nuôi đã được phép lưu hành tại Việt Nam:
Tổ chức, cá nhân chỉ được thay đổi các thông tin của thức ăn chăn nuôi đã được phép lưu hành tại Việt Nam nếu không làm thay đổi chất lượng sản phẩm, bao gồm: thay đổi tên gọi, địa chỉ, số điện thoại, số fax của tổ chức, cá nhân, số tiêu chuẩn công bố áp dụng, ký hiệu (tên thương mại), dạng, kích cỡ, màu của sản phẩm.
Tổ chức, cá nhân đề nghị thay đổi thông tin của thức ăn chăn nuôi, gửi 01 bộ hồ sơ trực tiếp hoặc qua đường bưu điện về Tổng cục Thủy sản hoặc Cục Chăn nuôi, hồ sơ bao gồm:
a) Đơn đề nghị thay đổi thông tin của thức ăn chăn nuôi (theo mẫu tại Phụ lục 5 ban hành kèm theo Thông tư này);
b) Bản sao chụp tiêu chuẩn công bố áp dụng, mẫu nhãn sản phẩm có xác nhận của nhà sản xuất, nhà nhập khẩu;
c) Bản chính giấy xác nhận nội dung thay đổi của nhà sản xuất (đối với thức ăn chăn nuôi nhập khẩu);
d) Bản sao chứng thực giấy chứng nhận đăng ký kinh doanh, giấy chứng nhận đầu tư hoặc giấy xác nhận của cơ quan nhà nước có thẩm quyền (trong trường hợp đổi tên cơ sở sản xuất, tên thương mại thức ăn chăn nuôi nhập khẩu).
Nếu chấp thuận cho phép thay đổi thông tin của thức ăn chăn nuôi, trong thời hạn không quá 05 ngày làm việc kể từ khi nhận được hồ sơ hợp lệ, Tổng cục Thủy sản hoặc Cục Chăn nuôi ban hành quyết định công nhận thay đổi thông tin của thức ăn chăn nuôi được phép lưu hành tại Việt Nam (theo mẫu tại Phụ lục 5A ban hành kèm theo Thông tư này). Trường hợp không chấp thuận, Tổng cục Thủy sản hoặc Cục Chăn nuôi phải trả lời bằng văn bản và nêu rõ lý do.
7. Thức ăn chăn nuôi dùng chung cho nuôi trồng thủy sản và chăn nuôi gia súc, gia cầm:
a) Tổ chức, cá nhân khi đăng ký thức ăn chăn nuôi được phép lưu hành tại Việt Nam hoặc điều chỉnh, bổ sung các thông tin có liên quan, gửi hồ sơ về Tổng cục Thủy sản và Cục Chăn nuôi.
b) Trình tự thủ tục và nội dung đăng ký thức ăn chăn nuôi dùng chung trong nuôi trồng thủy sản và chăn nuôi gia súc, gia cầm được phép

Pursuant to Decree No. 199/2013 / ND-CP of November 26, 2013 of the Government on the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Decree No. 08/2010 / ND-CP dated 05 May 2010 02 managed by the Government of feed;
At the request of the General Directorate of Fisheries, Department Livestock,
Minister of Agriculture and Rural Development issued a circular amending and supplementing a number of articles of Circular No. 66/2011 / TT-BNN October 10, 2011 stipulating in detail a number of articles of Decree No. 08/2010 / ND-CP dated 05 May 02, 2010 of the Government on the management of animal feed.
Article 1. To amend and supplement a number of articles of Circular No. 66/2011 / TT-BNN dated 10 October 2011 providing details of some articles of Decree No. 08/2010 / ND-CP dated 05 May 2010 02 Government's management of animal feed (hereinafter referred to as Circular 66/2011 / TT MARD) as follows:
1. Additional Article 2a:
"Article 2a. Interpretation
In this Circular, the following terms shall be interpreted as follows:
1. Lot production: is the feed contents on the label or similar attachments, including the product name, brand, quality components, manufacturing facility name, address production , date of manufacture and expiry date, batch production symbols (if any).
2. Shipment: merchandise is feed the same type of one or more batches produced by the same production facilities, the same organization imports, are imported at the same shipment and have the same set of admissions Export.
3. The main substances in animal feed: the quality of its decisions and the nature of the product, namely:
a) the quality of the finished feed and concentrated feed for cattle, poultry and seafood are crude protein and total lysine;
b) the quality of the ingredients and feed other criteria to determine the nature and utility of the product by the manufacturer announced and recorded on labels or technical documents attached. "
2. Article 5 is amended and supplemented as follows:
"Article 5. Recognition of feed is allowed to circulate in Vietnam
1. Animal feed is allowed to circulate in Vietnam as animal feed is the General Fisheries or the Department of Livestock eligibility circulation in Vietnam after the Minister of Agriculture and Rural Development approved agreement. General Fisheries, Department of Livestock are responsible for monthly sum, announced the list of feed is allowed to circulate in Vietnam and posted on the website of the General Directorate of Fisheries, Ministry of Agriculture and Animal Husbandry Department agriculture and rural development to organizations and individuals related to access and implement.
2. Animal feed is allowed to circulate in Vietnam must meet the following requirements:
a) Feed no national technical regulations: to announce applicable standards of quality and compliance with the disclosure standards apply.
b) Feed has national technical regulations: in addition to meet the provisions in clause 2 of this Article, shall complete disclosure under the provisions of regulation.
c) results in animal testing:
For a complete feed mixture: assay results by the Board of grassroots assessment (organizations and individuals to conduct testing and evaluating the results of assay the testing process by the Ministry of Agriculture and Rural Development issued);
for animal feed new assay results from specialized scientific council is the General Fisheries or the Department of Livestock established evaluation.
3. Registration dossier feed is allowed to circulate in Vietnam include:
a) For animal feed production in the country
- Application for animal feed is allowed to circulate in Vietnam (according to Form Schedule 3 attached to this Circular);
- Certificate of registration of business or investment certificate (certified copy, please submit the first time);
- The disclosure standards applicable (originals or copies certified copy of the manufacturer);
- Stamps test results (original or certified copy) the quality standards and safety of products in the published standards or regulations applicable National Technical respectively issued by the laboratory by the Ministry of Agriculture and Rural Development or admitted (for the targets announced no test method is specified). Assay results for the feed mixture completely. The reception publication published standards or receipt of conformity in accordance with the law or the decision to recognize the new feed;
- Sample product labels (with stamped and certified by the manufacturer).
b ) For animal feed imports are specified in Article 6 of Circular 66/2011 / TT-BNN.
4. Registration dossier to feed allowed to circulate in Vietnam include:
a) Application for the feed is allowed to circulate in Vietnam (in the form provided in Appendix 4 attached to this Circular );
b) The disclosure standards applicable (original or a copy certified by the manufacturer), announced the receipt of receiving standard or regulation conformity in accordance with the law or decision recognize new feed;
c) Form of product labels (with stamped and certified by the manufacturer).
5. The order of registration dossiers solve the feed is allowed to circulate in Vietnam (including re-registration):
a) Organizations and individuals registering feed is allowed to circulate in Vietnam, established 01 records directly or send by post to the Directorate of Fisheries (for aquaculture feed) or the Department of Livestock (for animal feed, poultry).
b) Within 03 working days from the date of receipt of the registration dossier, the General Fisheries or the Department of Livestock are responsible for component testing records and written notification to organizations and individuals to register the component record unsatisfactory to supplement and complete. Case records of over 10 products, the duration of examination of the dossier shall not exceed 05 working days.
c) If the application is valid and satisfactory product quality, within a period not exceeding 12 working days General Fisheries or Husbandry Department issued a decision recognizing the feed is allowed to circulate in Vietnam (in the form provided in Appendix 4A attached herewith) after the Minister of Agriculture and Development Rural approval. For over 10 product profiles, the time resolution for the excess is 01 plus 01 working days. Where the decision is not issued accreditation, the General Fisheries or the Department of Livestock must reply in writing, stating the reasons.
6. Change the information of feed was allowed to circulate in Vietnam:
An organization or individual can change the information of feed was allowed to circulate in Vietnam if they do not change the quality products, including changing the name, address, telephone number, fax number of organizations and individuals, the number of published standards applied, symbols (trade name), shape, size, color products.
Organizations and individuals requesting information change of feed, sending 01 records directly or by post to the Directorate of Fisheries or the Department of Animal Husbandry, each comprising:
a) Application proposed changes to the information of feed (in the form provided in Appendix 5 attached to this Circular);
b) Photocopies of published standards applicable label products certified by the manufacturer , the importer;
c) The original certificate of content changes by the manufacturer (for animal feed imports);
d) A copy of authentication certificate of business registration, investment certificates or certificate of authority competent state (in the case of renaming production facilities, trade names feed imports).
If approved for information change of feed, in period not exceeding 05 working days after receipt of a valid application, the General Fisheries or Husbandry Department issued a decision recognizing change information of the feed is allowed to circulate in Vietnam (according form in Appendix 5A attached to this Circular). In case of disapproval, the General Fisheries or the Department of Livestock must reply in writing, stating the reasons.
7. Animal feed used for aquaculture and livestock and poultry:
a) Organizations and individuals registered as animal feed is allowed to circulate in Vietnam or adjustment, additional information relevant documents sent to the Directorate of Fisheries and Livestock.
b) The order of procedure and subscription content shared feed in aquaculture and livestock, poultry is allowed
