Tòa án nhân dân tối cao là cơ quan

Tòa án nhân dân tối cao là cơ quan xét xử cao nhất của nước Cộng hoà xã hội chủ nghĩa Việt Nam. Tòa án nhân dân tối cao gồm có:

Hội đồng Thẩm phán Tòa án nhân dân tối cao;

Tòa án Quân sự trung ương, Toà Hình sự, Toà Dân sự, Toà Kinh tế, Toà Lao động, Toà Hành chính và các Toà Phúc thẩm Tòa án nhân dân tối cao; trong trường hợp cần thiết, Uỷ ban thường vụ Quốc hội quyết định thành lập các Toà chuyên trách khác theo đề nghị của Chánh án Tòa án nhân dân tối cao;

Bộ máy giúp việc. (khoản 2 điều 18 Luật TCTAND năm 2002).

Tòa án nhân dân tối cao (TANDTC) gồm có Chánh án, các phó Chánh án, các Thẩm phán, Thẩm tra viên, thư ký và chuyên viên.

Hội đồng Thẩm phán Tòa án nhân dân tối cao là cơ quan xét xử cao nhất theo thủ tục giám đốc thẩm, tái thẩm các bản án, quyết định đã có hiệu lực pháp luật của các Tòa án cấp dưới khi có căn cứ kháng nghị giám đốc thẩm, tái thẩm và là cơ quan hướng dẫn áp dụng thống nhất pháp luật trong toàn ngành. Hội đồng Thẩm phán Tòa án nhân dân tối cao bao gồm: Chánh án Tòa án nhân dân tối cao, các Phó chánh án và một số Thẩm phán do uỷ ban thường vụ Quốc hội quyết định theo đề nghị của Chánh án TANDTC, tổng số thành viên Hội đồng Thẩm phán không quá 17 người (Điều 21 Luật TCTAND 2002).

The Council of judges of the Supreme People's court included: Chief Justice of the Supreme People's Court, the Associate Chief Justice and some judges by the Committee of the National Assembly decided at the suggestion of Chief Justice TANDTC, the total number of members of the Board do not judge too 17 people (article 21 of law TCTAND of 2002).
