Để các chi phí trước hoạt động này được công nhận là phần góp vốn, thì ngoài việcphải được ghi nhận là chi phí của doanh nghiệp như nêu trên, các chi phí trước hoạt động này phải phù hợp với quy định tại các điều 22, điều 23 Nghị định số24/2000/NĐ-CP ngày 31/7/2000 của Chính phủ: Vốn đầu tư, vốn pháp định; phương thức, tiến độ thực hiện vốn phải được quy định tại Điều lệ doanh nghiệp và phải được Cơ quan cấp giấy phép đầu tư công nhận (được ghi cụ thể trong Giấy phép đầu tư cấp cho doanh nghiệp).
