Trường hợp người sử dụng lao động đơn phương chấm dứt hợp đồng lao động mà bị cơ quan có thẩm quyền kết luật là trái pháp luật thì phải nhận người lao động trở lại làm việc, ngoài ra còn phải bồi thường một khoản tiền tương ứng với tiền lương trong những ngày người lao động không được làm việc.
