Điều 19. Quyền lợi và trách nhiệm lợi của khách hàng tham gia dự thưởng vé xổ số truyền thống
1. Quyền lợi của khách hàng tham gia dự thưởng vé xổ số truyền thống
a) Khách hàng trúng thưởng được Công ty xổ số trả thưởng một lần, đầy đủ giá trị của các giải thưởng, bằng Việt Nam đồng, hình thức trả thưởng bằng tiền mặt hoặc chuyển khoản theo đề nghị của khách hàng trúng thưởng. Khoản tiền khách hàng trúng thưởng được nhận, là khoản tiền trúng thưởng trừ khoản thuế thu nhập cá nhân khách hàng trúng thưởng xổ số phải nộp quy định của Luật thuế thu nhập cá nhân.
b) Khách hàng trúng thưởng được uỷ quyền cho người đại diện hợp pháp của khách hàng trúng thưởng để lĩnh thưởng, việc ủy quyền được thực hiện bằng văn bản đúng quy định pháp luật hiện hành.
c) Được quyền yêu cầu Công ty xổ số giữ bí mật về thông tin trả thưởng của khách hàng trúng thưởng, ngoại trừ theo yêu cầu của cơ quan quản lý nhà nước có thẩm quyền.
2. Trách nhiệm của khách hàng tham gia dự thưởng vé xổ số truyền thống
a) Khách hàng tham gia dự thưởng vé xổ số truyền thống, nghiên cứu các quy định của pháp luật về vé xổ số truyền thống khi tham gia dự thưởng.
b) Tuân thủ Thể lệ tham gia dự thưởng vé xổ số truyền thống của Công ty xổ số.
c) Bảo quản tờ vé xổ số truyền thống đã mua để đảm bảo đủ điều kiện “vé lĩnh thưởng hoàn chỉnh” .
d) Khách hành trúng thưởng phải xuất trình vé trúng thưởng và các giấy tờ chứng minh thuộc đối tượng tham gia dự thưởng vé xổ số truyền thống theo quy định .
đ) Thực hiện đầy đủ nghĩa vụ thuế theo quy định của pháp luật về thuế.
e) Thực hiện các yêu cầu của Công ty xổ số khi tiến hành làm thủ tục lĩnh thưởng.
g) Khách hàng khi mua vé xổ số truyền thống để tham gia dự thưởng phải kiểm tra các đặc điểm của tờ vé số. Khách hàng không mua vé xổ số truyền thống không in hoặc in không đầy đủ 6 chữ số của dãy chữ số tham dự thưởng hoặc không có mộc giáp lai, .v.v...
Điều 20. Điều kiện lĩnh thưởng đối với vé xổ số truyền thống trúng thưởng
1. Vé xổ số truyền thống lĩnh thưởng hoàn chỉnh:
Vé xổ số truyền thống lĩnh thưởng hoàn chỉnh là vé xổ số do Công ty xổ số phát hành, phải còn nguyên hình, nguyên khổ, không rách rời, không chắp vá, không tẩy xóa, không sửa chữa, không thủng lổ và còn trong thời hạn lĩnh thưởng theo quy định.
2. Trường hợp vé xổ số truyền thống không đáp ứng đầy đủ các điều kiện tại khoản 1 Điều này, thì Công ty xổ số có quyền từ chối chi trả thưởng.
3. Trong trường hợp khách quan, vé xổ số truyền thống không đủ điều kiện lĩnh thưởng quy định tại khoản 1 Điều này thì Công ty xổ số có thể xem xét trả thưởng hoặc không trả thưởng.
a) Trường hợp thứ nhất:
Vé xổ số truyền thống trúng thưởng không đáp ứng điều kiện lĩnh thưởng quy định tại khoản 1 Điều này, nhưng thuộc một trong các trường hợp sau:
- Vé xổ số truyền thống trúng thưởng không bị nhầu nát, không biến dạng, không phai màu nhưng bị rách chưa rời.
- Vé xổ số truyền thống trúng thưởng không bị nhầu nát, không biến dạng, không phai màu nhưng bị rách rời mà chấp vá lại được.
- Vé xổ số truyền thống trúng thưởng bị nhầu nát, bị biến dạng, bị phai màu và bị rách nhưng chưa rời.
- Vé xổ số truyền thống trúng thưởng bị nhầu nát, bị biến dạng, bị phai màu và bị rách rời nhưng chấp vá lại được.
Theo các trường hợp trên, Công ty xổ số giải quyết như sau:
- Trả thưởng cho khách hàng trúng thưởng: Trong trường hợp Công ty xổ số xác định được vé xổ số truyền thống trúng thưởng do Công ty xổ số phát hành, các chữ số của dãy số tham dự thưởng còn đầy đủ, rõ ràng và thuận lợi trong việc so cùi lưu, đối chiếu mã vạch.
- Chuyển cơ quan chức năng giám định: Trong trường hợpxác định được vé xổ số trúng thưởng do Công ty xổ số phát hành, các chữ số của dãy số tham dự thưởng còn đầy đủ, rõ ràng nhưng không thuận lợi trong việc so cùi lưu, đối chiếu mã vạch thì chuyển cơ quan chức năng giám định. Sau khi có kết quả giám định của cơ quan chức năng, Công ty xổ số căn cứ vào kết quả giám định mà quyết định chi trả thưởng hay từ chối chi trả thưởng.
b) Trường hợp thứ hai:
Vé xổ số truyền thống bị rách rời mà không còn phần rách rời, để chấp vá lại (kể cả, bị nhầu nát, bị biến dạng, bị rách mà không chấp vá lại được), vị trí rách không ảnh hưởng đến các đặc điểm xác định tính xác thực của tờ vé như: Dãy số tham dự thưởng, các con thú, mộc giáp lai, kỳ vé, ngày mở thưởng và phần diện tích bị mất không quá 10% tổng diện tích.
Trong trường hợp này, nếu xác định được vé xổ số truyền thống trúng thưởng do Công ty xổ số phát hành và thuận lợi trong việc so cùi giáp lai, đối chiếu mã vạch, thì Công ty xổ số tiến hành trả thưởng cho khách hàng trúng thưởng. Ngược lại, thì Công ty xổ số chuyển cho cơ quan giám định, khi có kết quả giám định mà Công ty xổ số quyết định trả thưởng hay từ chối trả thưởng.
4. Vé xổ số truyền thống bị từ chối chi trả thưởng:
Công ty xổ số từ chối trả thưởng cho khách hàng tham gia dự thưởng đối với vé xổ số truyền thống:
a) Vé không do Công ty xổ số phát hành, vé giả mạo, vé photo bán trên thị trường với bất kỳ hình thức nào như: photo, in, kéo lụa, scan, cắt dán, cạo sửa, .v.v.

5. Khách hàng chịu trách nhiệm thanh toán chi phí giám định vé xổ số truyền thống không đủ điều kiện lĩnh thưởng quy định tại Khoản 1 Điều này được chuyển cho cơ quan chức năng giám định, không phân biệt là Công ty xổ số có trả thưởng hay không trả thưởng.
