Tòa án nhân dân huyện, quận, thị xã, thành phố thuộc tỉnh

Điều 32 Luật tổ chức Tòa án nhân dân năm 2002 quy định Tòa án nhân dân huyện, quận, thị xã, thành phố thuộc tỉnh (gọi chung là Tòa án nhân dân cấp huyện) gồm có:

- Chánh án;

- Một hoặc hai phó chánh án;

- Các Thẩm phán và thư ký Tòa án.

Ở Tòa án nhân dân cấp huyện không có bộ máy giúp việc nhưng có một số cán bộ công chức làm công tác văn phòng như: văn thư, lưu trữ, kế toán, thủ quỹ, bảo vệ … do Chánh án hoặc một phó chánh án phân công phụ trách.
