Để đảm bảo nghĩa vụ thực hiện hợp đồng của Bên được bảo lãnh với Bên nhận bảo lãnh theo thỏa thuận hợp đồng phụ số KLX-15/TC_001 được ký ngày 03/12/2015 cho Dự án xây dựng hệ thống thoát nước và xử lý nước thải thành phố Long Xuyên giữa Bên được bảo lãnh với Bên nhận bảo lãnh để thực hiện Hợp đồng xây dựng số VNM-38/LX-2015-05 ngày 15/09/2015- Dự án Hệ thống thoát nước và xử lý nước thải thành phố Long Xuyên – tỉnh An Giang giữa Công ty Cổ phần Điện Nước An Giang và Kumho Industrual Co., Ltd.
VCCB đồng ý phát hành Thư bảo lãnh này và khẳng định rằng sẽ thay mặt Bên được bảo lãnh chịu trách nhiệm thanh toán cho Bên nhận bảo lãnh trong phạm vi số tiền được bảo lãnh tối đa là 39.179.463.840 VND (Bằng chữ: Ba mươi chín tỷ một trăm bảy mươi chín triệu bốn trăm sáu mươi ba ngàn tám trăm bốn mươi đồng) khi VCCB nhận được đầy đủ các chứng từ sau đây trong thời gian làm việc của VCCB:
- Văn bản của Bên nhận bảo lãnh yêu cầu thực hiện nghĩa vụ bảo lãnh, trong văn bản phải chỉ rõ vi phạm của Bên được bảo lãnh và được ký bởi người đại diện hợp pháp của bên nhận bảo lãnh;
- Bản gốc Thư bảo lãnh này trong thời gian còn hiệu lực.
Thư bảo lãnh này có hiệu lực kể từ ngày phát hành đến 17 giờ 00 phút ngày 09/12/2017. Sau thời hạn này, Thư bảo lãnh sẽ hết hiệu lực dù bản gốc của Thư bảo lãnh này được hay không được hoàn trả cho Ngân hàng chúng tôi.
Bảo lãnh này được thực hiện và điều chỉnh bởi pháp luật của Việt Nam. Nếu phát sinh tranh chấp mà không thể giải quyết bằng thoả thuận, thì tranh chấp sẽ được Toà án nhân dân có thẩm quyền giải quyết.
Bảo lãnh này được phát hành duy nhất một bản gốc, không có giá trị chuyển nhượng. Ngôn ngữ được sử dụng trong Thư bảo lãnh này bằng Tiếng Việt. Trường hợp có bản dịch Tiếng Anh thì bản dịch chỉ có giá trị tham khảo.
