Trường hợp xảy ra tổn thất về thu nhập và lợi nhuận, tổn thất về cơ hội kinh doanh, tổn thất khách hàng và tổn thất sản xuất của Bên mua và khách hàng của Bên mua, Bên bán chỉ chịu trách nhiệm nếu Bên mua chứng minh được một cách hợp lý mối quan hệ nhân quả giữa thiệt hại thực tế xảy ra của Bên mua hoặc khách hàng của Bên mua với lỗi của Bên bán
