1. Tòa án nhân dân tối cao;

2. Các Tòa án nhân dân tỉnh,thành phố trực thuộc trung ương;

3. Các Tòa án nhân dân huyện,quận, thị xã, thành phố thuộc tỉnh;

4. Các Tòa án quân sự;

5. Các Tòa án khác do luật định.

Trong tình hình đặc biệt, Quốchội có thể quyết định thành lập Tòa án đặc biệt.
