Về mặt nội dung, luật pháp có tính quy phạm phổ biến. Luật pháp là do Nhà nước đặt ra, nên đối tượng điều chỉnh của nó phổ biến hơn (rộng rãi hơn) các quy phạm xã hội khác.

Về mặt hình thức, luật pháp có tính chặt chẽ. Để dân chúng biết được và phải biết ý chí của Nhà nước, thì ý chí này phải được thể hiện dưới các hình thức chặt chẽ. Có 3 hình thức luật pháp cơ bản, đó là tập quán pháp, tiền lệ pháp, và văn bản quy phạm pháp luật.
