Cơ quan hải quan là cơ quan bảo vệ

Cơ quan hải quan là cơ quan bảo vệ pháp luật về hải quan và luật pháp khác có liên quan. Đối tượng thi hành thủ tục hải quan, chế độ kiểm tra giám sát và thuế hải quan bao gồm các tổ chức và cá nhân có liên quan trong nước và ngoài nước. Vì vậy, hoạt động của cơ quan hải quan phải tuân theo những quy định của pháp luật Việt Nam, các điều ước quốc tế mà Việt Nam đã ký kết hoặc tham gia và các tập quán, thông lệ quốc tế về Hải quan.
Theo điều 5, Luật Hải quan Việt Nam:
Trong trường hợp điều ước quốc tế mà Việt Nam ký kết hoặc tham gia có quy định khác với quy định của Luật Hải quan thì áp dụng quy định của điều ước quốc tế đó.
Đối với trường hợp mà Luật Hải quan Việt Nam, các văn bản khác của Luật Hải quan Việt Nam, điều ước quốc tế mà Việt Nam ký kết hoặc tham gia chưa có quy định thì có thể áp dụng tập quán và thông lệ quốc tế về hải quan, nếu việc áp dụng tập quán và thông lệ quốc tế đó không trái với nguyên tắc cơ bản của pháp luật Việt Nam ( Luật Hải quan Việt Nam).

The Customs is the protection of customs legislation and other relevant laws. Therefore, the operation of the customs authority must comply with the provisions of the law of Vietnam, the international treaties to which Vietnam has signed or joined and the usages, practices of international customs.According to article 5, the Vietnam Customs Legislation:In the case of international treaties to which Vietnam signed or otherwise with provisions of customs law shall apply the provisions of international treaties.For cases in which the customs law of Vietnam, the other text of Vietnam Customs Law, international treaties to which Vietnam signed or yet to be defined, you can apply the usages and customs of international practices, if applying international practices and customs which are not contrary to the basic principles of the law of Vietnam (Vietnam-Customs Law).

Customs authorities shall protect the law on customs and other relevant legislation. Subjects enforcement of customs procedures, inspection and supervision regime and customs duties include the organization and individuals involved in the country and abroad. Therefore, activities of customs authorities must abide by the provisions of the law of Vietnam, the international treaties to which Vietnam has signed or acceded to and the practices, international rules on customs.
According to Article 5, the Customs Law Vietnam:
In the case of international treaties to which Vietnam has signed or acceded to contain provisions different from the provisions of the Customs Law shall apply the provisions of international treaties.
for the where Vietnam customs Law, other documents of Vietnam customs Law, international treaties that Vietnam has signed or acceded to no regulations, and practices applicable international rules and customs , if the application of customary international practice and is not contrary to fundamental principles of the law of Vietnam (Vietnam Customs Law).
