- Giải quyết tranh chấp trước ban hội thẩm và cơ quan phúc thẩm (nếu có)
Xét xử tại cơ quan phúc thẩm (Điều 17 DSU)
• Chỉ phúc thẩm “những vấn đề về giải thích luật” (issue of law not issue of fact) trong báo cáo ban hội thẩm
• Chỉ có các bên tranh chấp được yêu cầu phúc thẩm. Bên thứ 3 chỉ có thể gửi yêu cầu khi 1 trong các bên tranh chấp nộp đơn yêu cầu phúc thẩm
• Yêu cầu phúc thẩm phải được đưa ra trong vòng 60 ngày kể từ khi ban hội thẩm gửi báo cáo cho các nước thành viên (không được vượt quá 90 ngày).
