Điều 14. Thẩm định, lấy ý kiến góp ý về phương án bồi thường, hỗ trợ và tái định cư.
1. Thẩm định phương án bồi thường, hỗ trợ và tái định cư.
Trong thời hạn không quá 07 (bẩy) ngày làm việc kể từ ngày nhận được hồ sơ theo quy định tại khoản 2 Điều này do Tổ chức làm nhiệm vụ bồi thường, giải phóng mặt bằng gửi đến, Phòng Tài nguyên và Môi trường chủ trì, phối hợp với các phòng, ban có liên quan thẩm định phương án bồi thường, hỗ trợ và tái định cư.
Biên bản thẩm định phải có đầy đủ chữ ký của lãnh đạo và cán bộ đại diện các đơn vị tham gia thẩm định và được lưu trữ trong hồ sơ giải phóng mặt bằng theo quy định của pháp luật.
2. Hồ sơ để thẩm định phương án bồi thường, hỗ trợ và tái định cư.
a) Văn bản đề nghị thẩm định phương án bồi thường hỗ trợ và tái định cư của Tổ chức làm nhiệm vụ bồi thường giải phóng mặt bằng;
b) Biên bản về việc niêm yết công khai, biên bản lấy ý kiến về phương án bồi thường, hỗ trợ, tái định cư, bản tổng hợp cụ thể những ý kiến không đồng ý và ý kiến khác của người có đất thu hồi đối với phương án bồi thường, hỗ trợ, tái định cư;
c) Phương án bồi thường, hỗ trợ và tái định cư theo quy định tại điểm b khoản 3 Điều 13 Quy định này.
3. Xin ý kiến về phương án bồi thường, hỗ trợ và tái định cư
Đối với khu đất thu hồi theo quy định tại khoản 3, Điều 3 Quyết định số 38/2014/QĐ-UBND ngày 12 tháng 9 năm 2014 của Ủy ban nhân dân tỉnh Hà Nam, sau khi thẩm định xong phương án bồi thường, hỗ trợ và tái định cư, Tổ chức làm nhiệm vụ bồi thường, giải phóng mặt bằng gửi hồ sơ đến các sở, ngành của tỉnh có liên quan để xin ý kiến góp ý vào phương án. Hồ sơ bao gồm:
a) Văn bản đề nghị góp ý kiến vào phương án bồi thường, hỗ trợ của Ủy ban nhân dân cấp huyện;
b) Văn bản thẩm định phương án bồi thường, hỗ trợ và tái định cư;
c) Các văn bản nêu tại điểm b, c khoản 3 Điều 13 Quy định này.
Trong thời hạn 05 (năm) ngày làm việc kể từ ngày nhận đủ hồ sơ, các sở ngành có ý kiến góp ý bằng văn bản và gửi cho Ủy ban nhân dân cấp huyện.
