Theo quy định tại Điều 6 của Bộ luậ

Theo quy định tại Điều 6 của Bộ luật Hình sự Việt Nam thì công dân Việt Nam phạm tội ở ngoài lãnh thổ nước Cộng hòa xã hội chủ nghĩa Việt Nam có thể bị truy cứu trách nhiệm hình sự tại Việt Nam theo Bộ luật này. Như vậy, hành vi phạm tội ở nước ngoài của công dân Việt Nam vẫn bị xử lý theo pháp luật hình sự của Việt Nam.

Bên cạnh đó, việc xử lý tội phạm diễn ra tại nước ngoài còn cần đến sự hỗ trợ của nước bạn thông qua các Hiệp định tương trợ tư pháp về hình sự giữa Việt Nam và nước sở tại. Theo đó, việc dẫn độ tội phạm giữa hai nước phải bảo đảm phù hợp với những điều khoản đã ghi trong Hiệp định tương trợ tư pháp, nước ký kết này sẽ dẫn độ công dân của nước ký kết kia đang ở trên lãnh thổ của nước mình cho nước kia để tiến hành truy cứu trách nhiệm hình sự hoặc để thi hành bản án, quyết định hình sự. Đặc biệt, việc dẫn độ phải đáp ứng điều kiện dẫn độ và không thuộc các trường hợp từ chối dẫn độ cũng thường được quy định trong Hiệp định tương trợ tư pháp hoặc theo quy định của nước sở tại.

Trong trường hợp, không có hiệp định tương trợ tư pháp việc tương trợ trong việc dẫn độ, hỗ trợ điều tra … sẽ phụ thuộc vào sự hợp tác của các quốc gia trên nguyên tắc có đi có lại trong từng trường hợp cụ thể. Nếu nước bạn không dẫn độ người phạm tội, thì người này có thể bị xử lý theo quy định và trình tự tố tụng tại nước sở tại. Khi đó, các cơ quan có thẩm quyền của Việt Nam có thể xem xét để truy cứu trách nhiệm hình sự hoặc cho thi hành bản án, quyết định hình sự của Tòa án nước ngoài đối với công dân Việt Nam bị từ chối dẫn độ.
