2. Giải thích về năng lực của các bên tham gia hợp đồng
Chủ thể của hợp đồng dân sự là những người tham gia xác lập, thực hiện hợp đồng hợp đồng, có quyền, nghĩa vụ phát sinh từ hợp đồng và phải chịu trách nhiệm về việc thực hiện quyền, nghĩa vụ phát sinh từ hợp đồng đó.
