Điều 22. Sự kiện bất khả kháng và nguyên tắc xử lý
22.1. Sự kiện bất khả kháng
Sự kiện bất khả kháng là sự kiện xảy ra một cách khách quan không thể lường trước được và không thể khắc phục được mặc dù đã áp dụng mọi biện pháp cần thiết và khả năng cho phép. Sự kiện bất khả kháng có thể bao gồm nhưng không giới hạn, những sự kiện hay trường hợp bất thường thuộc loại được liệt kê dưới đây:
a. Chiến tranh, tình trạng chiến tranh (bất kể có tuyên bố chiến tranh hay không), sự xâm lược, hoạt động của kẻ thù nước ngoài;
b. Các thiên tai như động đất, mưa lốc, bão hay hoạt động của núi lửa, sóng thần.
22.2. Nguyên tắc xử lý
22.2.1. Trong các trường hợp xảy ra sự kiện bất khả kháng, không Bên nào phải chịu trách nhiệm về việc không hoàn thành các nghĩa vụ theo Hợp đồng BOT này.

22.1. The force majeure

22.2.1. In the event of a force majeure event, neither Party shall be liable for failure to fulfill the obligations under the BOT contract.
