23.3. Trình tự thủ tục chấm dứt Hợp đồng BOT
23.3.1. Các Bên thực hiện theo trình tự, thủ tục dưới đây để chấm dứt Hợp đồng BOT:
a. Bên dự định chấm dứt Hợp đồng BOT này phải gửi thông báo bằng văn bản cho Bên kia về dự kiến chấm dứt Hợp đồng BOT, trong đó xác định rõ căn cứ chấm dứt Hợp đồng BOT.
b. Trong thời hạn ba mươi (30) ngày, hoặc thời hạn khác do các Bên thỏa thuận tại thời điểm đó, kể từ ngày của thông báo, các Bên phải tổ chức cuộc họp với sự tham gia của đại diện có thẩm quyền của các Bên về việc giải quyết các sự kiện chấm dứt Hợp đồng. Trong trường hợp các Bên đạt được thỏa thuận về việc thực hiện các công việc hoặc kế hoạch để giải quyết các sự kiện chấm dứt Hợp đồng, thông báo chấm dứt Hợp đồng này sẽ đương nhiên hết hiệu lực.
c. Trong trường hợp các Bên không đạt được thỏa thuận hoặc thống nhất về việc giải quyết các sự kiện chấm dứt Hợp đồng, Bên dự kiến chấm dứt Hợp đồng BOT có thể chấm dứt Hợp đồng BOT bằng việc gửi thông báo chính thức tới Bên kia và Bên cho vay về việc chấm dứt Hợp đồng BOT này. Trong trường hợp đó, Hợp đồng BOT này sẽ được chấm dứt vào ngày của thông báo đó hoặc ngày được xác định trong thông báo.
