3. Các bên có quyền đơn phương huỷ bỏ hợp đồng nếu bên kia vi phạm hợp đồng. Bên huỷ bỏ hợp đồng phải có nghĩa vụ báo ngay cho bên kia biết trong thời hạn 03 ngày. Nếu không thực hiện nghĩa vụ thông báo mà việc huỷ bỏ hợp đồng gây thiệt hại cho bên kia thì bên huỷ bỏ hợp đồng phải bồi thường thiệt hại. Hợp đồng bị huỷ bỏ không có hiệu lực kể từ thời điểm bị huỷ bỏ, các bên có trách nhiệm hoàn trả cho nhau phần chi phí đã bỏ ra theo biên bản nghiệm thu hoặc các giấy tờ xác nhận khối lượng và chi phí đã bỏ ra để thực hiện hợp đồng.
