25.2. Bảo mật
25.2.1. Nghĩa vụ chung của các Bên của Hợp đồng BOT này: Trong thời hạn có hiệu lực của Hợp đồng BOT này, mỗi bên có thể tiếp nhận từ hoặc tiết lộ cho Bên kia các thông tin bảo mật liên quan đến Dự án hoặc hoạt động của Nhà đầu tư, Doanh nghiệp dự án. Ngoại trừ trường hợp được quy định cụ thể trong thỏa thuận giữa Các Bên hoặc cho mục đích để đạt được những phê chuẩn cần thiết từ Chính phủ hoặc [Bbb], bên tiếp nhận thông tin sẽ phải thực hiện các hoạt động sau đây trong thời hạn có hiệu lực của Hợp đồng BOT hoặc cho đến khi những thông tin được tiếp nhận này đã được công bố công khai:
a. Không tiết lộ thông tin khi đã tiếp nhận cho bất kỳ cá nhân hoặc tổ chức nào ngoại trừ nhân viên hoặc cố vấn của bên đó hoặc [Bbb], Bên cho vay trong phạm vi mà cá nhân hoặc tổ chức đó cần thiết hoặc yêu cầu được biết các thông tin đó để thực hiện trách nhiệm của mình;
b. Không sử dụng thông tin đã tiếp nhận cho mục đích nào khác ngoài mục đích thực hiện Hợp đồng này, trừ các trường hợp theo yêu cầu của Cơ quan quản lý nhà nước có thẩm quyền.

Except in the case set forth in the specific agreement between the parties or for the purpose to achieve the necessary approval from the Government or [Bbb], the party receiving the information would have to perform the following activities during the term of the contract or the BOT until the information was received has been publicly :a. not disclose the information when received for any individual or any organization except employees or that party's counsel or [Bbb], on loan to the extent that the individual or organization that needed or requested to know the information to perform their responsibilities;b. do not use information received for any purpose other than the purpose of performing this contract, except in the case at the request of the State Agency of competent jurisdiction.

25.2.1. General obligations of the Parties to this BOT contracts: During the validity of this BOT Agreement, either party may receive from or disclosure to other parties of confidential information related to the project or activity of investors, enterprise project. Except for cases specified in the agreement between the parties or for the purpose to achieve the required approvals from the government or [Bbb], the reception information will have to perform the following activities in the effective duration of the BOT contract, or until the information is received has been publicized:
a. Do not disclose information when they have received to any individual or organization except employees or advisors of that party or [Bbb], the Lender to the extent that individuals or organizations that need or request needs to know such information to perform their responsibilities;
b. Do not use information received for any purpose other than the purpose of implementing this Agreement, except for the case at the request of the state management agency having jurisdiction.
