1. Hợp đồng số 158-5 và ký kết giữa IEE và LISEMCO ngày 23/11/2011 và Thỏa thuận bổ sung số 6 của Hợp đồng số 158-5 về việc ký kết Bảo lãnh Công ty thay thế cho Bảo lãnh Ngân hàng về hoàn trả tiền ứng trước;
2. Bảo lãnh Tiền Ứng trước Công ty số 001/158-5 cho số tiền 1,368,208.00 USD do LISEMCO phát hành ngày 28/001/2015;
3. Yêu cầu thanh toán theo Bảo lãnh Tiền Ứng trước Công ty số 001/158-5;
4. Xác nhận của DHL về việc giao nhận bản gốc Yêu cầu thanh toán theo Bảo lãnh Tiền Ứng trước Công ty số 001/158-5;
5. Thỏa thuận Trọng tài đã được ký kết giữa IEE và LISEMCO vào ngày …/…/2015;
6. Thỏa thuận chỉ dẫn trọng tài viên duy nhất và thúc đẩy thủ tục tố tụng trọng tài đã được ký kết giữa IEE và LISEMCO vào ngày …/…/2015.
YÊU CẦU
Dựa trên các tài liệu và chứng cứ kèm theo Đơn khởi kiện này, Công ty TNHH INTER ENERGY EQUIPMENT có yêu cầu sau đây:
LISEMCO phải ngay lập tức, không chậm trễ thanh toán số tiền 1,368,208.00 USD (Một triệu ba trăm sáu mươi tám nghìn hai trăm linh tám Đô la Mỹ) cho IEE theo Bảo lãnh Tiền Ứng trước Công ty của LISEMCO phát hành ngày 28/01/2015.

Theo Thỏa thuận Trọng tài và Thỏa thuận chỉ dẫn trọng tài viên duy nhất và thúc đẩy thủ tục tố tụng trọng tài đã được ký kết giữa IEE và LISEMCO vào các ngày …/…/2015 và ngày …../…../2015, chúng tôi lựa chọn Hội đồng Trọng tài giải quyết tranh chấp gồm 01 trọng tài viên duy nhất là Ông Đỗ Khắc Chiến – Trọng tài viên của Trung tâm Trọng tài Quốc tế Việt Nam (VIAC).
Chúng tôi rất mong Quý Trung tâm Trọng tài xem xét và giải quyết, bảo đảm quyền và lợi ích hợp pháp cho Công ty của chúng tôi!

2. Guarantees Cash Advance Company No. 001 / 158-5 for the amount of USD 1,368,208.00 by issuing LISEMCO 28/001/2015 day;
3. Demand payment under the Guarantee Cash Advance Company No. 001 / 158-5;
4. Confirm delivery of DHL on the original request the payment under the Guarantee Cash Advance Company No. 001 / 158-5;
5. Arbitration Agreement was signed between IEE and LISEMCO on th ... / ... / 2015;
6. Negotiable indications sole arbitrator and promote arbitration proceedings have been concluded between IEE and LISEMCO on th ... / ... / 2015.
REQUIREMENTS
Based on the documents and evidence accompanying the petition this , Ltd. ENERGY EQUIPMENT INTER following requirements:
LISEMCO should immediately, without delay, pay an amount of USD 1,368,208.00 (One million three hundred and sixty-eight thousand two hundred and eight dollars) for the IEE under the Guarantee Cash Advance company LISEMCO released on 01.28.2015.
SELECTION arbitrator
According Arbitration Agreement and Agreement indications sole arbitrator and promote arbitration proceedings have been concluded between IEE and LISEMCO on the date ... / ... / 2015 and dated ... ../ ... ../ 2015, we selected the Arbitration Council dispute resolution including 01 sole arbitrator is Mr. Do Khac Chien - Referee member of the International Arbitration Centre Vietnam (VIAC).
